LEGAL NOTICE OF INTENT TO ISSUE A PLAN APPROVAL AND AMEND A TITLE V OPERATING PERMIT ¶ Notice is hereby given pursuant to 25 Pa. Code Sections 127.44(b) and 127.424(b), that the Pennsylvania Department of Environmental Protection (DEP) intends to issue Plan Approval 10-00079G to BNZ Materials, Inc. (BNZ) for their Zelienople Plant located at 191 Front Street, Zelienople Township, Butler County. The plan approval will subsequently be incorporated into the facility’s Title V Operating Permit (TVOP) 10-00079 thro-ugh an administrative amendment in accordance with 25 Pa. Code Section 127.450. ¶ BNZ is a facility that manufactures insulating fire brick refractory materials. Plan Approval 10-00079G is for the installation of an existing control device to capture the particulate matter (PM) emissions from Kiln #3. The subject control device is a 12,000-cfm wet scrubber that functions as a counter-flow packed bed scrubber system with a vent gas quench tank and a wet control packed bed scrubber. On August 25, 2025, the DEP received BNZ’s plan approval application and have developed Plan Approval 10-00079G to address the changes BNZ is making to their Zelienople Plant facility. ¶ Plan Approval 10-00079G will propose no changes to the existing emission limits associated with Kiln #3. The facility shall continue to follow the existing fuel and throughput restrictions as well. Based on the information provided by the applicant and DEP’s own analysis, the subject source will result in potential emissions not to exceed: 9.90 tpy of PM/PM-10/PM-2.5. The plan approval authorizes the usage of a magnehelic gauge, pH probe or meter, and liquid flow meter to provide daily readings and records of the control device. The subject ratings for each indicator shall be determined within 180 days of commencement of operation or by the initial performance test and approved by the DEP. The facility shall keep records of all preventative maintena-nce inspections of the source and daily operational inspections. Mon-thly and yearly records of gas usage, sawdust usage, and production clay throughput are also required. All records shall be kept for a period of 5 years and be made available to the DEP upon request. The control device shall operate at all times that Kiln #3 is in operation and both shall be maintained and operated in accordance with the manufacturer’s specifications and in accordance with good air pollution control practice. The plan approval also includes stack testing conditions to determine the PM emission rate (filterable and condensable). ¶ The subject source(s) will be subject to the applicable requirements of 25 Pa. Code Chapters 123 and 127. The plan approval will contain testing, monitoring, reporting, recordkeeping, and work practice require-ments designed to keep the facility operating within all applicable air quality requirements. ¶ Copies of the application, DEP’s analysis, and other documents used in the evaluation are avail-able for public inspection between the hours of 8:00 A.M. and 4:00 P.M. weekdays at the address shown below. LEGAL NOTICE OF INTENT TO ADOPT ORDINANCE ¶ The Summit Township Board of Supervisors will, at its regularly schedule meeting on May 6, 2026, at 6:45 P.M., at the Summit Township Municipal Buil-ding, 502 Bonniebrook Road, Butler, PA 16002, vote on adopting an Ordinance which is entitled “An Ordinance Regu-lating the Business of Transient Merchants Within the Township of Summit, Butler County, Pennsylvania, Requiring Transient Merchants to Obtain Licenses, Establishing License Fees, Providing for the Enfor-cement of the Provisions of the Ordinance and Penalties for Violations Thereof.” ¶ A summary of the Ordinance is as follows: ¶ Section 101 - Sets forth definitions of “soliciting,” “peddling,” and “canvassing”. Sets forth exceptions for farmers selling their goods, the sale of goods by IRS tax-exempt entities, the sale of goods for school projects or activities, and persons providing proof of compliance with the Pa.
