OF INTENT TO
ADOPT ORDINANCE
¶ The Summit Township Board of Supervisors will, at its regularly schedule meeting on May 6, 2026, at 6:45 P.M., at the Summit Township Municipal Buil-ding, 502 Bonniebrook Road, Butler, PA 16002, vote on adopting an Ordinance which is entitled “An Ordinance Regu-lating the Business of Transient Merchants Within the Township of Summit, Butler County, Pennsylvania, Requiring Transient Merchants to Obtain Licenses, Establishing License Fees, Providing for the Enfor-cement of the Provisions of the Ordinance and Penalties for Violations Thereof.”
¶ A summary of the Ordinance is as follows:
¶ Section 101 - Sets forth definitions of “soliciting,” “peddling,” and “canvassing”. Sets forth exceptions for farmers selling their goods, the sale of goods by IRS tax-exempt entities, the sale of goods for school projects or activities, and persons providing proof of compliance with the Pa. Solicitation of Funds for Charitable Purposes Act.
¶ Section 102 - States the prohibition of solicitation or peddling without a license.
¶ Section 103 - Sets forth the application requirements.
¶ Section 104 - Fees are to be established by Resolution of the Supervisors.
¶ Section 105 - Licenses are for a maximum period of one month and then must be renewed.
¶ Section 106 - Sets forth standard of conduct, prohibits operations on Sundays or official holidays, and limits operations from 9:30 A.M. to 8:00 P.M.
¶ Section 107 - The Code Enforcement Officer of Summit Township will maintain all records.
¶ Section 108 - Sets forth the bases for the suspension of licenses.
¶ Section 109 - Sets forth the process of appeal from suspended licenses.
¶ Section 110 - Sets forth prohibition upon the utilization of “hawking or crying,” loudspeakers, bells, whistles, and the like, and electronic or flashing signage.
¶ Section 111 - Establishes a fine of $600.00, plus court costs and attorney’s fees for the violation of the Ordinance.
¶ Section 112 - Sets forth a severability clause.
¶ Section 113 - Sets forth a repealer clause.
¶ Copies of the full text of the Ordinance are available at the Summit Township Municipal Bui-lding during regular office hours, the Butler County Law Library (located in the Butler County Court-house), Butler, Pennsylvania, and at this newspaper and may be examined without charge or obtained for a charge not greater than the cost thereof.
