Articles 5, 6, 7 and 8 address the Sinking Fund Depository, events of default, and amendment and discharge of the security documents.¶ Article 9 contains federal income tax covenants and certain elections and designations related to the Notes; Article 10, securities law covenants.¶ Article 11 provides for the sale of the Notes, establishes certain funds and sets forth certain directions for Settlement; in particular, this Article contains a ratification of the termination of an existing Qualified Interest Rate Management Agreement, in order to alter the variable rate nature of certain debt service obligations of the School District, thereby eliminating terms, covenants and restrictions applicable to the same which have been determined to be unduly burdensome and better manage the School District’s future debt service obligations.
